Welcome to the website of The TC Advantage (“we,” “us,” or “our”). By accessing or using this website, submitting intake forms, or engaging our services, you agree to be bound by the following Terms and Conditions. If you do not agree, please do not use this website or our services.
 

Scope of Services

The TC Advantage provides transaction coordination and administrative support services only, under the direction of licensed real estate agents and brokers operating in the State of California.

We do not:

  • Provide legal, financial, tax, or real estate advice

  • Negotiate terms of a transaction

  • Act as a principal or agent in a real estate transaction

  • Represent buyers or sellers

All services are administrative in nature and performed at the instruction of the engaging agent and broker.
 

Eligibility & Use

Our services are intended for licensed real estate agents and brokers or their authorized representatives. By submitting a file or intake form, you represent that you are authorized to engage our services and to share transaction-related information.
 

Intake Forms & File Submission

A completed intake form is required each time a file is submitted. Submission of an intake form does not guarantee acceptance. Work begins only after file acceptance by The TC Advantage.

Files submitted outside required timelines or without complete information may be subject to additional fees as outlined in your service agreement.
 

Fees & Payment

Fees are charged on a per-file basis and are earned upon file acceptance. Payment is typically collected through escrow at closing, unless otherwise agreed in writing.

All fees are non-refundable, as outlined in our Refund Policy, except as required by law.

Additional fees may apply, including but not limited to cancellation fees or rush fees, as disclosed in the Expectations & Services Agreement.
 

Cancellations

If a transaction is cancelled or fails to close, fees remain due for services rendered or resources allocated. Any applicable cancellation fees will be governed by your executed service agreement.
 

No Guarantee of Outcome

The TC Advantage does not guarantee:

  • That a transaction will close

  • Timelines of third parties

  • Approval of loans, inspections, or escrow

  • Accuracy of information provided by others

We are not responsible for delays or failures caused by agents, clients, lenders, escrow, inspectors, or other third parties.
 

Compliance & Broker Responsibility

Agents and brokers remain fully responsible for:

  • Compliance with California DRE regulations

  • Accuracy and completeness of all disclosures

  • Client communication and representation

  • Review and approval of all documents

The TC Advantage assists with compliance file management but does not assume broker or fiduciary responsibility.
 

Confidentiality & Data Handling

We handle transaction information in accordance with our Privacy Policy. By using our services, you authorize us to receive, store, and share information as necessary to perform administrative tasks at your direction.
 

Intellectual Property

All website content, branding, logos, text, and materials are the property of The TC Advantage and may not be copied, reproduced, or used without prior written permission.
 

Website Use

You agree not to:

  • Use the website for unlawful purposes

  • Submit false or misleading information

  • Attempt to access restricted systems or data

  • Interfere with website functionality or security

We reserve the right to restrict or terminate access for violations.
 

Limitation of Liability

To the fullest extent permitted by law, The TC Advantage shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of our website or services.

Our total liability, if any, shall not exceed the fees paid for the specific file giving rise to the claim.
 

Indemnification

You agree to indemnify and hold harmless The TC Advantage from any claims, damages, or liabilities arising from:

  • Information provided by you or your clients

  • Your failure to comply with applicable laws or regulations

  • Misuse of our services or website
     

Governing Law

These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles.
 

Modifications

We reserve the right to update or modify these Terms and Conditions at any time. Updates will be posted on this page with a revised effective date.
